Copyright
Office Evaluation Of The DMCA Earns NARM's Kudos, Concern
The
Digital Millennium Copyright Act of 1998 was Congress's first effort to
implement U.S. treaty obligations and move U.S. copyright law into the
digital age. As part of an ongoing evaluation, the Copyright Office was
recently asked to evaluate and comment on the creation of a digital first
sale doctrine and the creation of an exemption for the making of certain
temporary incidental copies.
"The
conclusions and recommendations of the Copyright Office, with respect to
the ongoing issues of the Digital Millennium Copyright Act (DMCA), offer
much which is encouraging and much which is of concern to both retailers
and consumers," states NARM President Pamela Horovitz. "First,
we are pleased that the Copyright Office agrees with NARM's view that the
first sale doctrine applies to lawfully downloaded digital copies. ...
However, we are troubled by their assertion that the first sale doctrine
serves merely as a 'limitation to the distribution right of copyright
owners' and it 'is not an enforceable right from the standpoint of the
owner of a copy.'"
